What is a Trust Deed & why does it matter?

The Trust Deed is important. It’s the document that sets out the rules, practices, kawa and tikanga for how the Trust must operate to look after our settlement.

Why is the Trust Deed being reviewed?

We need to ensure the Trust Deed is a relevant, living document that meets current governance standards and is legally robust. It must be fit for purpose and serve our hapū, iwi, trustees and beneficiaries.

The review is an opportunity to ask:

  1. Does the Trust Deed still reflect the aspirations and priorities of our whānau?
  2. Does it enable the Trust to operate effectively and transparently?
  3. Are there provisions in the Trust Deed that are outdated, unclear, or don’t reflect current practice or our vision?

What changes are proposed?

An earlier legal review of the Trust Deed was done by Whāia Legal, with initial recommendations made. But to complete a full review, we need to hear from you.

Once we have your whakaaro and suggestions, we will identify the key themes and share these with you. Your feedback will inform our review and any proposed amendments to the Trust Deed.

What engagement have we completed to date?

We provided an update to our members at our AGM in January this year, and conducted our first online survey for our members (we will present a summary of results at our upcoming hui).

What happens next?

We are going to hold hui in Mangakino, Tāmaki-nui-a-Rua, Wairarapa, and online.

Once the review has been completed, the proposed amendments will be written as resolutions to update the Trust Deed. We will share these with you.

A Special General Meeting will then be held for all our adult registered members to vote. For the proposed amendments to be adopted, at least:

  1. 75% of the members who vote, must vote in support, and
  2. 20% of all our adult registered members must vote. This can be in person at the Special General Meeting or by postal or digital vote, as determined by the Trustees.
